Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HomeFood platform, website, and related services (collectively, the "Platform"), operated by HomeFood ("HomeFood," "we," "us," or "our"). By accessing or using the Platform, you agree to these Terms.

If you do not agree, do not use the Platform.

1. Platform Role and Scope

HomeFood is a neutral online platform that enables users to list, discover, and communicate regarding goods offered by independent third parties.

HomeFood:

  • does not prepare, cook, handle, store, inspect, package, or deliver food;
  • does not verify or guarantee the quality, safety, legality, freshness, or availability of any goods;
  • does not act as a seller, distributor, restaurant, caterer, or food business;
  • is not a party to any transaction between users.

All transactions, communications, and arrangements occur directly between users.

2. User Accounts

You may be required to create an account to access certain features. You are responsible for:

  • maintaining the confidentiality of your credentials;
  • all activity conducted through your account.

HomeFood may suspend or terminate accounts that violate these Terms or applicable law.

3. Sellers

Sellers are independent individuals or businesses who choose to list goods on the Platform.

Sellers are solely responsible for:

  • the preparation, handling, storage, labeling, pricing, and sale of goods;
  • determining whether they are legally permitted to sell goods in their jurisdiction;
  • complying with all applicable local, state, and federal laws and regulations;
  • accurately describing goods offered.

HomeFood does not verify seller compliance, permits, licenses, or inspections.

4. Buyers

Buyers are responsible for:

  • evaluating listings and sellers independently;
  • arranging payment and pickup directly with sellers;
  • assuming all risks associated with purchasing and consuming goods.

HomeFood makes no representations regarding seller reliability or product safety.

5. Transactions and Payments

HomeFood does not process, hold, escrow, or verify payments between users.

Any payment references, confirmations, or status indicators on the Platform are user-declared only and do not constitute verification or endorsement by HomeFood.

Payment disputes, non-payment, refunds, and chargebacks are solely between buyers and sellers.

6. Pickup and Fulfillment

HomeFood does not coordinate or guarantee fulfillment.

Buyers and sellers independently arrange pickup, timing, and logistics through direct communication. HomeFood bears no responsibility for missed pickups, delays, or failures to fulfill.

7. Prohibited Conduct

Users may not:

  • list or offer illegal goods or services;
  • misrepresent goods, identity, or authority;
  • violate applicable laws or third-party rights;
  • use the Platform for fraudulent or deceptive purposes.

HomeFood reserves the right to remove content or accounts upon receipt of credible notice of prohibited or illegal activity.

8. Notice and Takedown

Upon receiving credible notice that specific content or conduct violates law or these Terms, HomeFood may remove or disable access to such content or accounts. HomeFood has no obligation to proactively monitor listings or user activity.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

HOMEFOOD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HOMEFOOD DOES NOT WARRANT THAT:

  • LISTINGS ARE ACCURATE OR LEGAL;
  • GOODS ARE SAFE, FRESH, OR AVAILABLE;
  • USERS WILL PERFORM AS EXPECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEFOOD SHALL NOT BE LIABLE FOR:

  • PERSONAL INJURY, ILLNESS, OR PROPERTY DAMAGE;
  • USER DISPUTES;
  • FOOD SAFETY OR LEGAL COMPLIANCE ISSUES;
  • LOST PROFITS OR CONSEQUENTIAL DAMAGES.

HOMEFOOD'S TOTAL LIABILITY, IF ANY, SHALL NOT EXCEED $100.

11. Indemnification

You agree to indemnify and hold harmless HomeFood from any claims, damages, losses, or expenses arising from:

  • your use of the Platform;
  • your listings or transactions;
  • your violation of law or these Terms.

12. Termination

HomeFood may suspend or terminate access at any time, with or without notice, for any reason, including violation of these Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Exclusive venue shall lie in the courts of that state.

14. Changes to Terms

HomeFood may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
